HAMILTON, N.J. (December 21, 2016) – Jeff Slivka, president of New Day Underwriting Managers LLC will join a panel of insurance and legal experts to discuss the expanding standard of care in design/build contracts at the 2017 Conference on Surety Bonding and Construction Risk Management. Hosted January 30 to February 1, 2017, by the Associated General Contractors of America (AGC) at the Ritz-Carlton Golf Resort in Naples, Florida, the event is dedicated to exploring risk management trends, practices and experiences throughout the entire construction process.  

“Contractor responsibilities have become increasingly complex in today’s design/build environment,” said Slivka. “Many project owners are increasingly looking for the most efficient and equitable methods for transferring the uninsurable risks related to design or professional service errors. As a result, the construction industry needs to understand the consequences of accepting risk without the proper risk management strategies in place. This panel will highlight the rewards and challenges associated with design/build projects as well as the alternatives for insuring against costly and timely errors and omissions.”   

Scheduled for Tuesday, January 31, Slivka will be joined by leading industry experts in the discussion titled Climate Change: Where and How Design-Build Contracts Are Requiring General Contractors and Construction Managers to More Than Meet the Standard of Care for the Designs They Provide. The session will begin by reviewing the contract terms and conditions that increasingly seek to hold design-builders liable for any and all design defects – whether negligent or not. It will then highlight how these agreements depart from historical norms, while offering tactical recommendations for reducing or limiting risk. This includes discussing the insurance products currently available to protect contractors from financial loss, as well as the catastrophic problems that can actually ruin businesses.
